Pulse Terms of Sale

These Terms of Sale apply when you purchase Pulse from KlompTech via Gumroad or any successor checkout provider.

1. Overview

These Terms of Sale ("Terms") govern your purchase of Pulse from Alex Hovenkamp ("Seller", "we", "us"). They apply in addition to the End User License Agreement ("EULA"), which governs your right to use the Software after purchase.

By completing a purchase, you agree to these Terms and the EULA.

2. What you are buying

You are purchasing a license to use a specific version of Pulse, not ownership of the Software and not a subscription. Pulse is proprietary commercial software distributed as:

• a Docker image (application) for one version (for example, pulse:1.0.0), and
• an install pack containing Docker Compose configuration, example configuration files, documentation, and license notices.

The scope of your license is defined in the EULA. These Terms govern the commercial transaction; the EULA governs use of the Software.

You are not buying: updates, upgrades, support, maintenance, service levels, compatibility with future third-party APIs, or any obligation on Seller to continue developing or distributing Pulse.

3. Eligibility

You must be at least eighteen (18) years old (or the age of majority in your jurisdiction) and legally able to enter a binding contract.

If you purchase on behalf of an organization, you represent that you have authority to bind that organization to these Terms and the EULA.

4. Business and consumer purchases

Pulse may be purchased by businesses and individuals. Unless mandatory law provides otherwise:

• if you purchase using a business name, VAT ID, or for business purposes, you represent that you act in a business capacity; and
• if you purchase as a consumer (an individual acting for purposes outside your trade or profession), certain mandatory consumer protections may apply regardless of these Terms.

Nothing in these Terms limits rights that cannot be limited under applicable consumer law. Where you have mandatory rights (for example, certain refund or remedy rights), those rights apply despite anything to the contrary in these Terms.

5. Gumroad as sales platform

Pulse is sold through Gumroad, which provides payment processing and digital delivery.

Contract. The sale contract for the Software is between you and Alex Hovenkamp. Gumroad acts as a third-party platform for checkout, payment, and file delivery.

Gumroad terms. Your use of Gumroad's checkout, payment, and delivery services may also be subject to Gumroad's own terms of service and privacy policy.

Delivery. After successful payment, Gumroad provides access to download the install pack and Docker image.

If there is a conflict between these Terms and Gumroad's platform terms regarding payment processing on Gumroad, Gumroad's terms govern that limited subject matter. For all matters relating to the Software license, these Terms and the EULA prevail.

6. Price and payment

The price displayed on the product page at the time of purchase is the price you pay, unless otherwise stated.

Payment is processed through Gumroad. Seller does not store your full payment card details.

Any taxes, VAT, or similar charges may be calculated and collected by Gumroad or payment providers in accordance with applicable law.

Pricing errors. Seller reserves the right to cancel or correct orders affected by manifest pricing or description errors, with a refund of amounts paid if the order is not fulfilled.

Chargebacks and fraud. Seller may refuse or terminate license recognition and pursue available remedies if a payment is reversed, charged back, or made fraudulently.

7. Delivery

Delivery is electronic and complete when download links are made available. Upon successful payment, you receive access to:

1. Install pack — documentation, Docker Compose file, configuration examples, and license notices; and
2. Docker image — the Pulse application image for the purchased version.

You are responsible for downloading, storing, and securing your files. Seller is not obligated to provide indefinite re-download access beyond what Gumroad's platform offers.

Risk of loss. Risk passes when files are made available for download.

No ongoing delivery obligation. Seller has no duty to deliver additional files, replacements, or updates after initial delivery except as required by law.

8. License identification

Your license is associated with the purchasing organization or individual as reflected on the Gumroad receipt, unless otherwise agreed in writing.

For business purchases, ensure billing details correctly identify the licensed entity.

9. Refunds and EU consumer withdrawal

9.1 General policy

Because Pulse is digital software delivered immediately upon purchase, refunds are not offered except where required by applicable law.

9.2 No satisfaction guarantee

Seller does not offer money-back guarantees, trial periods, or refunds for change of mind, compatibility issues with Customer's environment, misconfiguration, or failure to meet Customer's expectations, except where mandatory law requires otherwise.

9.3 Statutory rights

If you are a consumer in a jurisdiction that provides mandatory withdrawal, refund, or remedy rights, those rights apply as required by law.

9.4 European Union — digital content

If you are a consumer in the European Union, you may have a fourteen (14) day right of withdrawal for distance contracts. However, where applicable law permits and you expressly consent at checkout to immediate delivery of digital content and acknowledge loss of the withdrawal right once delivery begins, the withdrawal right may not apply after delivery has started.

10. Updates — no right to future versions

Your purchase includes only the version available at the time of download.

You have no right to future releases, upgrades, bug fixes, security patches, or new features. Each later version requires a separate purchase or written agreement, even if Seller publishes newer versions for other customers.

Seller may discontinue Pulse or stop distributing any version at any time without liability.

11. Support

No technical support is included or provided. Seller does not provide installation help, configuration assistance, troubleshooting, or defect remediation under the purchase price.

12. Representations

By purchasing, you represent that:

(a) you are legally able to enter into a binding contract;

(b) if purchasing on behalf of an organization, you have authority to bind that organization;

(c) you have evaluated whether the Software meets your needs before purchase;

(d) you will use the Software in compliance with the EULA and applicable law; and

(e) you are not prohibited from receiving the Software under applicable export control or sanctions law.

13. Warranty and liability

Warranty disclaimers and limitations of liability are set out in the EULA, which is incorporated by reference.

Seller's total liability in connection with the sale is subject to the same aggregate cap and exclusions as the EULA (limited to the purchase price or EUR 50, whichever is greater, with no indirect damages, to the maximum extent permitted by Dutch law).

14. Privacy

Seller processes purchase-related information necessary to fulfill your order and respond to licensing inquiries. Seller does not sell personal data.

Payment data is processed by Gumroad and its payment providers.

Seller does not receive or store your Jira, ClickUp, or other third-party API credentials.

15. Transfer and assignment

You may not transfer your purchase or license without Seller's prior written consent, as set out in the EULA.

Seller may assign these Terms in connection with a sale of the business relating to Pulse, provided the assignee honors your existing rights.

16. General provisions

Governing law. The laws of the Netherlands.

Disputes. Courts of the Netherlands, subject to mandatory consumer jurisdiction rules.

Entire agreement. These Terms, the EULA, and Support Policy are the entire agreement regarding your purchase. Marketing copy, emails, and demos do not create obligations.

Severability. If any provision is unenforceable, the remainder remains in effect.

Force majeure. Seller is not liable for failure due to circumstances beyond reasonable control.

Changes. Updates apply to future purchases only. Your Order is governed by the version in effect at purchase.
